These Terms and Conditions ("Terms") govern your access to and use of the mobile applications, websites, and related services (collectively, the "Services") operated by Loading... ("us", "we", or "our").

Please read these Terms carefully before using any of our Services.

By accessing or using any of our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Services.

Eligibility

Our Services are intended for users of all ages, in accordance with the applicable App Store age rating. If you are under 16 years of age, you should review these Terms with a parent or guardian before using the Services. Parents and guardians are responsible for supervising their children's use of the Services.

Purchases

Some of our Services may offer products or features available for purchase ("Purchase"). All purchases made through our mobile applications are processed by Apple via the App Store. We do not collect or store your payment details. All billing, payment processing, and transaction disputes are handled by Apple in accordance with Apple's terms and policies.

We reserve the right to modify, discontinue, or limit the availability of any product or service at any time.

Subscriptions

Some parts of the Services are billed on a subscription basis ("Subscription(s)"). Subscriptions are managed and billed through Apple's App Store. You will be billed in advance on a recurring basis ("Billing Cycle"), set on either a monthly or annual basis depending on the plan you select.

At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it. You may cancel your Subscription at any time through your Apple ID account settings. For details on managing or cancelling subscriptions, please refer to Apple's support documentation.

Free Trials

We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). Free Trials are managed through the App Store. Unless you cancel your Subscription before the Free Trial expires, you will be automatically charged the applicable Subscription fees.

We reserve the right to (i) modify the terms of a Free Trial offer, or (ii) cancel such Free Trial offer at any time and without notice.

Fee Changes

We may, at our sole discretion and at any time, modify the Subscription fees. Any fee change will become effective at the end of the then-current Billing Cycle.

We will provide reasonable prior notice of any change in Subscription fees to give you an opportunity to cancel your Subscription before such change becomes effective.

Your continued use of the Services after a fee change comes into effect constitutes your agreement to pay the modified Subscription fee.

Refunds

All purchases and subscriptions are processed through the App Store. Refund requests should be directed to Apple in accordance with their refund policies. Except when required by applicable law, paid Subscription fees are non-refundable.

Your Data

Any data you create or store using our apps remains yours. Our apps store data locally on your device or in your personal iCloud account. We do not access, collect, or claim any rights over your data.

Your Use of the Services

You are responsible for your use of the Services and for any activity that occurs through your device. Our apps rely on your Apple ID and iCloud account for authentication and data storage. You are responsible for maintaining the security of your Apple ID and device credentials. We are not responsible for any loss or damage arising from unauthorized access to your device or Apple account.

Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of Loading... and our licensors. The Services are protected by copyright, trademark, and other laws of Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Availability, Errors, and Inaccuracies

We are constantly updating our offerings of products and services. The products or services available through the Services may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information.

We do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, or descriptions. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Links to Third-Party Services

Our Services may contain links to third-party websites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available through any such third-party websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to stop using the Services, you may simply discontinue use and, if applicable, cancel any active Subscriptions through your Apple ID account settings. Since our apps store data locally on your device and in your personal iCloud account, your data remains under your control.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Loading... be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your data, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that (a) the Services will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Services are free of viruses or other harmful components; or (d) the results of using the Services will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Hesse, Germany, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Services, and supersede and replace any prior agreements.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Services.
